Can I claim compensation if my Uber driver gets in a car accident?

Were you in an accident in an Uber? Chat to our car accident lawyers today.

From the moment their services were introduced to the public, Uber gained traction quickly, and now it is the preferred mode of ride-sharing in Australia. According to a study on Australian ride-sharing providers by Roy Morgan, 93% of Australians are using Uber. However, accidents happen and if you are injured in an Uber vehicle, you need to know your rights.

My rights as an injured passenger

If you sustain an injury as a passenger in a vehicle in Australia, you will be covered by the Compulsory Third Party (CTP) insurance. Every driver must have CTP insurance, and this includes Uber drivers as well.

You are eligible to make car accident insurance claims for both physical and psychological injuries as a passenger.

What do I need to do to make a claim against Uber?

The process to make a claim against Uber is very much the same as making a claim against any other driver. After all, Uber drivers are using their own private vehicles.

To ensure you can make a successful claim, collating evidence is critical. If you are unsure about the evidence required, speak to one of our compensation lawyers – car accident claims are their specialty.

Generally speaking, if you are involved in a car accident whilst in an Uber, to make a claim, you should do the following:

  • Check for any injury to you or any other passengers, and call the paramedics if required.
  • Call the police and report the accident within 28 days. This is a must.
  • Take down the registration details of the Uber, and any other vehicle involved in the accident. Use the Uber app to report the car accident to Uber. Through the app, you will be able to report the date of the accident and your location in the vehicle at the time of the accident. The app will also ask you a series of other questions including whether the vehicle was towed or if anyone was hospitalised.
  • Pictures are also very helpful when lodging a car accident claim. Take pictures at the scene and upload them onto the Uber app car accident reporting form.

It’s important to remember some injuries may not be identifiable immediately so you need to continue to monitor for any signs of injury, even a few weeks after the accident. It is always a good idea to consult a doctor for a check up following a car accident.

How long after a car accident can I claim?

Although the process can be relatively straightforward to make a claim against Uber, one of the biggest pitfalls people face is making the claim within time. A car accident claim must be made within 28 days, and must be reported to the police. For this reason, it’s important to collate the evidence as soon as possible and lodge the claim. If 28 days have lapsed since the accident took place, you can still make a claim, however, it is best to speak with one of our lawyers on how to lodge the late claim.

Should I make a claim against Uber?

Knowing your rights and understanding the claim process for road accidents can be challenging and time consuming. However, the effort is worth it when there are medical and financial benefits that you may be entitled to if you are injured in an Uber.
